ORIGINAL

Alice W. Poole executed her Last Will and Testament on July 22, 1939. Article THIRTY-SEVEN of said Will states as follows: "All the rest, residue and remainder of my property and estate of every kind and wherever situated, I give, bequeath and devise to the Town of Jaffrey, as trustee, in trust, to hold, manage and invest the principal thereof and to pay the income thereof to a committee of five, the members of which shall be chosen annually, one to be named by the Directors of the Monadnock National Bank, or its successors, two by the District Nurse Association and two by the East Congregational Church. Said committee shall expend said income in providing additional comforts for elderly people, children and the youth of the Town of Jaffrey, to take steps to promote the health of said community, to make loans to pupils to assist them in obtaining education, it being my intention in particular to assist in promoting and improving the health and mental improvement of the youth of said Town and to aid the elderly residents thereof. In expending said fund it is my desire to vest in the committee a wide and inclusive discretion."

MODIFIED
That the terms of the trust be modified as follows: The Alice W. Poole Fund Committee shall consist of five (5) members, who are and continue to be residents of Jaffrey, who are at least twenty-one (21) years of age. Each member of the Committee shall serve for a term of five (5) years. Initial appointments and vacancies shall be filled by the then serving remaining members of the Committee. Any vacancy occurring prior to the expiration of that memberís term shall be filled for the unexpired term. One member of the Committee shall be a member of and chosen by the United Church of Jaffrey. One member of the Committee shall be a member of Saint Patrick Church of Jaffrey and chosen by the existing Committee. One member of the Committee shall be a representative of the Jaffrey School System and chosen by the existing Committee. Two members of the Committee shall be residents of Jaffrey and represent the public at large and chosen by the existing Committee.
